Terms & Conditions – Medication Subscription

1. Scope and Applicability
1.1 These Terms & Conditions apply exclusively to the agreement between the patient (“Patient”) and Nationale Apotheek in relation to the medication subscription (“Medication Subscription”).
1.2 Additional conditions apply to the Medication Subscription in connection with a separately agreed healthcare service subscription with the healthcare provider (“Healthcare Service Subscription”).
1.3 The general terms and conditions of Nationale Apotheek (available at: https://nationale-apotheek.nl/algemene-voorwaarden/) remain applicable to all pharmacy-related services, including medication supply, delivery, payment, and returns.
1.4 In the event of any conflict:
- these Terms prevail in respect of the Medication Subscription;
- pharmacy-related matters remain governed by the pharmacy terms.
2. Conditions for the Medication Subscription
2.1 It is a condition of the Medication Subscription that the Patient has a corresponding and active Healthcare Service Subscription, is and remains eligible for the prescribed medication, and holds a valid prescription from the healthcare provider.
2.2 If the Healthcare Service Subscription is terminated, suspended, or becomes invalid, the Medication Subscription shall also terminate in accordance with these Terms and to the extent permitted by applicable law.
2.3 The Patient acknowledges and accepts these conditions upon entering into the agreement.
3. Duration and Commencement
3.1 The Medication Subscription is entered into for a minimum commitment period, as communicated to the Patient prior to entering into the subscription.
3.2 Upon expiry of the minimum commitment period, the Medication Subscription shall terminate unless extended in accordance with clause 4.
4. Renewal and Continuation
4.1 Prior to the expiry of the minimum commitment period, the Patient may be offered an extension of the Medication Subscription.
4.2 If the Patient takes no action, the Medication Subscription shall terminate at the end of the agreed contract period.
4.3 The Patient will be informed accordingly in due time.
5. Medication Supply
5.1 Medication is supplied solely on the basis of a valid prescription from the healthcare provider and only insofar as a corresponding and active Healthcare Service Subscription is in place.
5.2 The Patient must strictly comply with all prescribed instructions regarding use and storage.
6. Medication Switching
6.1 In the event of medical necessity or an emergency, medication may be changed at the initiative of a physician. If Nationale Apotheek so requires in connection with such change, the Patient must return the relevant medication to the pharmacy.
6.2 A non-medical change of medication at the Patient’s request is only permitted within the transition periods applied by Nationale Apotheek and after consultation with a physician. Any such change shall take effect only on the basis of a new prescription and a new medication cycle.
7. Termination
7.1 Upon expiry of the agreed contract period as referred to in clause 4, the Patient may terminate the Medication Subscription in accordance with these Terms.
7.2 If medically necessary, the Medication Subscription may be terminated with immediate effect. In such case, unused medication must be returned to the pharmacy.
7.3 Nationale Apotheek is entitled to terminate the Medication Subscription with immediate effect if the conditions referred to in clause 2 are no longer met.
7.4 Early termination is only possible following prior consultation with and approval by Nationale Apotheek and shall be assessed on a case-by-case basis, including in situations involving serious personal or financial circumstances.
7.5 Upon termination, the Patient shall pay the pharmacy for any remaining medication, or return such medication to the pharmacy if and to the extent prior coordination has taken place and the pharmacy has granted its approval.
7.6 The Medication Subscription may remain in force only for as long as the conditions set out in clause 2 continue to be met.
8. Defective Medication
8.1 In the event of suspected defects, the pharmacy will support the Patient in the assessment and handling thereof, provided that the pharmacy shall not be liable for defects beyond its legal obligations.
9. Patient Responsibilities
9.1 The Patient is required to follow medical advice, store medication properly, and report any issues in a timely manner.
9.2 Any loss, improper use, or negligence shall be at the Patient’s risk and expense and shall not entitle the Patient to replacement or refund.
10. No Pause Policy
10.1 The Medication Subscription cannot be paused.
11. Automatic Invoicing
11.1 By entering into the Medication Subscription, the Patient agrees to automatic periodic invoicing and collection.
11.2 Payments shall be charged periodically and collected using the payment method provided by the Patient.
11.3 The Patient is responsible for providing and keeping accurate payment details up to date and for maintaining sufficient funds.
11.4 Invoices shall contain a clear specification of the charges invoiced.
12. Returns and Medication Handling
12.1 Medication returns shall be handled in accordance with the terms of Nationale Apotheek.
12.2 Returns shall not automatically entitle the Patient to a refund.
13. Disputes and Applicable Law
13.1 This agreement shall be governed by Dutch law.
13.2 Disputes relating to healthcare services shall be governed by the agreement with the healthcare provider. Disputes relating to medication shall be governed by the pharmacy agreement.
14. Final Provisions
14.1 These Terms may be amended periodically.
